How Trump and All His Co-defendants Will Win

In a nutshell: get one Trump voter on the juries. You need all 12 jurors to agree that someone is guilty. You need only one Trump voter on the jury to acquit. Who wins? The lawyers who will make millions. The media who will be transfixed with this legal circus. It'll end up being much ado about nothing. If Trump happens to be found guilty and actually faces jail time, he will probably leave the country. Why should a billionaire or semi-billionaire, who has assets in other countries and probably money stashed away off shore, willingly go to some sleazy jail or even some country club jail when he could live well in some other country? Trump is not exactly a loyal American citizen who adheres to the rule of law and playing fair. He can declare from abroad that he is some sort of President in Absentia and his loyal followers will still probably send him money. He will say he is prepared to come back to America as soon as his followers take political power and he can come in riding on a white horse.
Trump and his lawyers like constitutional scholar John Eastman who set up the fake electors scheme will work the system, and, if they can't convince one juror of their innocence, they will get themselves pardoned by the next elected Republican President which could be in 2024. American voters are nothing if not fickle. They have one of the best Presidents in American history who, despite great odds, accomplished more than anyone since Lyndon Johnson. Biden's popularity is in the tank despite his accomplishments. Why is this? Maybe because of his age. Maybe because he's not "charismatic" enough. Trump voters seem to be impressed by his charisma first and foremost. I guess charisma and popularity, not competence, is what gets you elected President in this country. Even as he faces 91 criminal indictments, on the TV it's all Trump, all the time. Just like the movie Trump is everywhere all the time all over the place.
Trump and his lawyers had a scheme for replacing electors, but it was not all that far fetched. Until 1913 state legislatures had control over electors. Passed by Congress on May 13, 1912, and ratified on April 8, 1913, the 17th Amendment modified Article I, Section 3, of the Constitution by allowing voters to cast direct votes for U.S. senators. Prior to its passage, senators were chosen by state legislatures. So Eastman and others were just trying to argue that there was something unconstitutional about the 17th Amendment. The Supreme Court might have been convinced that he was right and the state legislatures should have the final say in which case Trump would have been elected, not Biden. Republicans have used the Supreme Court before to get George W Bush elected in 2000 despite the fact that, when all the votes were counted, Al Gore really won the election. Bush convinced the Supreme Court to stop counting the votes. The result was the disastrous George W Bush administration in which he lied us into the Iraq war.
Republicans have been using dirty tricks for years to get themselves elected including gerrymandering and doctoring voter rolls to eliminate black voters. Black politicians and activists say that Republican lawmakers have used racial gerrymandering and voter suppression to secure those majorities and are using their political might to further consolidate power among mostly White Republicans. Republicans have been busy removing black voters from registration lists. According to Mother Jones: Fifty-five percent of the registration notices were sent to municipalities where Hillary Clinton had defeated Donald Trump, according to the Milwaukee Journal Sentinel, and nine of the 10 areas with the highest concentration of voters on the purge list were big cities and college towns that had voted for Clinton. Milwaukee and Madison, the state’s two Democratic strongholds, accounted for 14 percent of the state’s registered voters but 23 percent of the names on the removal list. Voters in predominantly Black neighborhoods or areas with large student populations were nearly twice as likely to be flagged for removal, The Guardian found.
Trump and his lawyers just took dirty tricks to a whole new level. Now they will win in court just by the process of jury selection. It only takes one to find any of the myriad of defendants not guilty.
