Evidently, There's No Federal Law Against Fomenting a Coup
by John Lawrence
It's now clear that Donald Trump did everything within his considerable power as President to foment a coup and overturn the result of the 2020 Presidential election including directing a mob of insurrectionists to attack the Capitol and the Congress persons and staffers inside. Trump also called on Georgia's Secretary of State to overturn the result of Georgia's election results and then pressured the DOJ to do the same. "Just say that the election was corrupt and leave the rest to me and the R. Congressmen," Trump said in a December phone call with former Acting Attorney General Jeff Rosen, according to handwritten notes of the conversation. What more proof is needed, and why isn't Trump in jail? Some say the Constitution is vague on this point, and there's no Federal law that Trump violated. Really? Well then, they had better rewrite the Constitution.
The House select committee investigating the attack by pro-Trump rioters who were trying to stop the certification of the presidential election will undoubtedly find even more information about Trump's role in overturning a US election, especially after they investigate his phone logs from January 6 and interview Defense Department officials who Trump may have pressured not to come to the aid of Capitol and Metropolitan police. What is clear is that the US came to about a hair's breadth of a coup on that day. If either Nancy Pelosi or Michael Pence had been apprehended by the rioters, that in and of itself may have enabled Trump to "leave the rest to him."
"Donald Trump urged the Justice Department to say publicly that "the election was corrupt" even as its top officials tried unsuccessfully to convince him that claims of widespread voter fraud were false, according to newly released documents about conversations between the former president and the agency's leadership. ...
"The disclosures provide more insight into how Trump tried to use the country's top law enforcement agency to back claims that the last election had been stolen from him even though the Justice Department had found no evidence of widespread fraud that would've changed the results. The notes, written by Rosen's deputy, were released Friday by the House Oversight and Reform Committee, which is investigating efforts by Trump to overturn President Joe Biden's win."
How much detail does Congress need for the result to be that Trump is charged for sedition. Sedition is overt conduct, such as speech and organization, that tends toward rebellion against the established order. Sedition often includes subversion of a constitution and incitement of discontent toward, or insurrection against, established authority. Surely, there was both overt conduct and speech on the part of Trump that qualifies his speech and action as sedition. Yet there is no Federal law that would put him in jail awaiting trial? Give me a break. Evidently, the Constitution has all kinds of holes in it not the least of which is allowing every nut case to own as many AK-47s as he can afford. Also the free speech that is tolerated on the internet regarding reinstating Donald Trump as President or misleading people about COVID can't be reined in by law? Evidently, the President of the US can choose to send people into battle in a foreign country whenever he wants to like George W Bush did by lying to Congress, but the President of the US can't mandate that everyone get vaccinated in order to halt the destruction of the American people by a pandemic? What is evident is that the destruction caused by a virus is greater than the destruction wreaked by all wars in the US' history. Yet the President is powerless to do what is needed to bring it under control. He should just declare a state of emergency and mandate that everyone get vaccinated.
